Do I Need a Notary Before Apostille?

Yes, for documents that begin as a private signature. An affidavit, a power of attorney and a single-status declaration are first notarised, then attested by the SDM or Home Department in the issuing state, and only then apostilled by the MEA in New Delhi. A passport-office PCC and university-issued documents do not need a private notary. Using a private notary alone, without the SDM or Home Department step, is the most common reason the MEA adds a disclaimer or the document is later rejected abroad.

Power of Attorney attestation or apostille in India is a commercial-document workflow, but it has a specific quirk that catches applicants out: a fresh PoA executed in India is usually drafted and signed in the presence of an Indian notary, then attested through the sequence, but a PoA drafted abroad and intended for use in India (the reverse direction) cannot be authenticated through MEA; it has to be apostilled or legalised in the country where it was executed, and then used in India.

For a PoA drafted in India and going abroad, the order is: Notary at the place of execution, then SDM (Sub-Divisional Magistrate) at the state level, then MEA apostille (for Hague destinations) or MEA attestation plus destination-country Embassy attestation in India (for non-Hague destinations). For a PoA drafted in India and going to a non-Hague country like UAE or Kuwait, certified Arabic translation is commonly required after the Embassy attestation. For property-related PoAs going to GCC countries, the receiving authority sometimes additionally requires the document to be presented at the relevant overseas Indian Mission.

PoA drafting is critical to whether the document does what the principal needs it to do. Common drafting issues that we flag at the scan review before any attestation begins are: vague scope ("all matters" rather than specific powers like"to sell the property at X, to receive sale proceeds, to execute conveyance deed"), missing witness names or addresses, missing photograph or biometric attachments where the receiving authority requires them, validity window not stated, agent's authority over sub-delegation not stated. A poorly drafted PoA passes the sequence cleanly but is then rejected at use; the order is not a substitute for proper drafting.

    When does a POA need apostille or attestation?

    Whenever someone abroad will rely on it. Hague destinations (the USA, the UK, Germany, Saudi Arabia, and 120 plus others) accept the MEA apostille on an Indian-executed POA. Non-Hague destinations (UAE, Qatar, Kuwait, Libya) need the destination embassy's attestation after MEA instead. The receiving bank, court, registrar, or company decides which proof it wants, so we read that requirement first.

    What is the POA attestation process in India?

    It moves in four steps. The POA is drafted and signed on stamp paper before a notary. The SDM or state Home Department attests the notarised document. MEA in New Delhi places the apostille for Hague destinations, or its attestation stamp for non-Hague ones. The destination embassy in Delhi stamps non-Hague documents last. A commercial POA signed by a company goes through the Chamber of Commerce instead of the SDM.

    How long does POA apostille take?

    Signing and notarising can happen the same day, and the SDM and MEA steps usually finish inside two weeks. Spend the saved time on drafting. One extra day on scope and witness details saves weeks of rework if the foreign bank or registrar rejects vague wording.

    Can SiZA handle POA for NRIs abroad?

    It depends on where the POA is signed. If it was executed in India, for example during a visit, or your family holds it in India, we run the full process on your behalf. If you are signing the POA abroad, it has to be attested by the Indian Embassy or Consulate there first. That step happens outside India, so only the India-side work after it can be ours.     What Chamber of Commerce attestation means for commercial POA?

    A POA signed by a company, authorising a distributor, opening a branch, or signing contracts abroad, is a commercial document. Its first step is attestation by the Chamber of Commerce with jurisdiction over the company's registered office, not the SDM. After the Chamber, MEA attests or apostilles, and a non-Hague destination embassy stamps it last.

    What is an apostille?

    An apostille is a single official stamp issued by India's Ministry of External Affairs (MEA) on the back of an Indian document. Once placed, the document is accepted in any country that is a member of the 1961 Hague Apostille Convention, about 125 countries today, including the USA, UK, Italy, Germany, France, Saudi Arabia (since 2022), and Canada (since 2024). For non-Hague destinations such as UAE, Qatar, Kuwait, Libya, and Egypt, MEA apostille alone is not enough, the document needs MEA attestation plus the destination country's embassy attestation in India.

    Is apostille required for Saudi Arabia?

    Saudi Arabia joined the Hague Apostille Convention in December 2022. For Indian documents going to Saudi Arabia today, MEA apostille (after the relevant pre-step, State HRD for educational documents, SDM or Home Department for civil documents) is the standard India-side authentication. The previous Saudi Embassy + Cultural Attaché route was discontinued in December 2022; some Saudi employers still ask for QVP / Mosaddaqa qualification verification or SCFHS DataFlow PSV separately for licensed professions.
