Do I Need a Notary Before Apostille?

Yes, for documents that begin as a private signature. An affidavit, a power of attorney and a single-status declaration are first notarised, then attested by the SDM or Home Department in the issuing state, and only then apostilled by the MEA in New Delhi. A passport-office PCC and university-issued documents do not need a private notary. Using a private notary alone, without the SDM or Home Department step, is the most common reason the MEA adds a disclaimer or the document is later rejected abroad.

Affidavits are personal legal declarations (name-change affidavits, address affidavits, relationship declarations, one-and-same-person certificates, and similar notarised statements) that sometimes need apostille or attestation before being submitted to overseas courts, immigration offices, employers, or authorities.

Unlike educational or civil certificates, affidavits do not go through HRD or Home Department. The typical process is SDM (Sub-Divisional Magistrate) or Executive Magistrate attestation at the district level before MEA apostille for Hague countries, or MEA attestation and embassy attestation for non-Hague countries.     Can an affidavit be apostilled?

    It can be. A notarised affidavit covering name change, relationship declarations, address proof or one-and-same statements is apostilled by MEA after SDM or Executive Magistrate attestation. One exception worth knowing: Italy's DoV process does not accept ordinary affidavits for name mismatches; the Tehsildar-issued One-and-Same Certificate is what works.

    What is the SDM attestation process for an affidavit?

    The affidavit is sworn before a notary on stamp paper first, because it begins life as a private signature. The SDM or Executive Magistrate then attests the notarised affidavit, which is what MEA acts on, and MEA places the apostille last. Skipping the SDM step and relying on the notary alone is the most common reason affidavit cases bounce.

    When is an apostilled affidavit needed?

    Whenever a foreign authority wants a sworn statement from India it can legally rely on: name-spelling declarations, unmarried or relationship declarations, address and identity statements, sponsorship declarations, and gap-year explanations for universities. The receiving office's wording matters, so the affidavit text is drafted to answer exactly what they asked.

    How long does affidavit attestation take?

    Same-day drafting and notarisation is normal. Hague destinations then finish in about ten days through the SDM or Executive Magistrate and MEA. Non-Hague destinations like the UAE and Kuwait add the embassy stamp on top, which extends the schedule by days to weeks depending on the embassy.

    What is an apostille?

    An apostille is a single official stamp issued by India's Ministry of External Affairs (MEA) on the back of an Indian document. Once placed, the document is accepted in any country that is a member of the 1961 Hague Apostille Convention, about 125 countries today, including the USA, UK, Italy, Germany, France, Saudi Arabia (since 2022), and Canada (since 2024). For non-Hague destinations such as UAE, Qatar, Kuwait, Libya, and Egypt, MEA apostille alone is not enough, the document needs MEA attestation plus the destination country's embassy attestation in India.

    Is apostille required for Saudi Arabia?

    Saudi Arabia joined the Hague Apostille Convention in December 2022. For Indian documents going to Saudi Arabia today, MEA apostille (after the relevant pre-step, State HRD for educational documents, SDM or Home Department for civil documents) is the standard India-side authentication. The previous Saudi Embassy + Cultural Attaché route was discontinued in December 2022; some Saudi employers still ask for QVP / Mosaddaqa qualification verification or SCFHS DataFlow PSV separately for licensed professions.
