Affidavit translation: key facts for 2026

The affidavit is the supporting cast
Affidavits rarely travel abroad alone. The destination authority usually reads the primary document (degree certificate, marriage certificate, birth certificate, passport) and the affidavit explains a discrepancy or supplies a declaration that the primary document does not state. The name on the degree does not match the name on the passport because of marriage; the affidavit explains the link. The spelling of the parent\'s name on the birth certificate differs from the spelling on the passport; the affidavit declares one-and-same. The candidate has a gap year between school and university; the affidavit explains the gap.
We see affidavits most often as part of a larger bundle. The bundle has a primary document (apostilled) and one or more supporting affidavits (apostilled) and sometimes supporting evidence (apostilled marriage certificate, gazette publication, passport copy). The destination authority; ACS Australia, US OCI, Italian DoV, German Standesamt; reads the bundle.

Common affidavit types and what each declares
One-and-same affidavit (name variation). Declares that two or more name forms; maiden and married name, name with initial and name with full first name, name with regional-language spelling and name with English spelling; refer to one and the same person. The affidavit names the forms and the reason for the variation.
Name-change affidavit (post-deed-poll or post-gazette). Declares the legal name change after a Gazette of India publication or a court order. Often part of a name-change bundle with the gazette publication and the updated passport.
Date-of-birth affidavit. Declares the correct DoB where the birth certificate has an error and re-issuance is not feasible. Used alongside other ID documents.
Parents\' name affidavit. Where the birth certificate shows one form of the parent\'s name and the parent\'s current passport shows another. Often used for OCI of children where parent name verification cross-checks fail.
Gap year affidavit. Declares the period of an academic gap and the reason. Used for university admission abroad.
Joint ownership affidavit. Confirms joint ownership of property, financial assets, or business stake. Used for UAE banking, US bank account joint holding, inheritance cases.
Parental consent affidavit for minor children\'s travel. Required by some destinations and some airlines when one parent travels with a minor child without the other parent. The other parent signs the affidavit consenting to the travel.
Address proof affidavit. Declares the applicant\'s current residence address where rental agreements, utility bills, or other proofs are absent. Used for bank account opening, visa applications.
Single status affidavit. Declares unmarried status for marriage abroad. We handle this on a separate page; the affidavit is one type of supporting document.
Affidavit of inheritance. Declares the legal heirs of a deceased person. Often used in conjunction with Legal Heirship Certificate from the Tahsildar or Succession Certificate from the court.
Each affidavit is drafted to the destination authority\'s expected reading. Generic affidavits get rejected; specific, named declarations are accepted.
Which authority will actually read this affidavit
ACS Australia (Australian Computer Society) for skills assessment. Name-mismatch one-and-same affidavit, with marriage certificate and gazette publication. Notary, SDM, MEA apostille. ACS reads the affidavit alongside the apostilled degree and experience certificates.
US OCI (Overseas Citizenship of India). Name-mismatch and parent-name affidavits alongside the apostilled birth or marriage certificates. CKGS has been zero-tolerance on single-letter mismatches for OCI; the affidavit-only path is risky. Where a corrected certificate is feasible, the corrected certificate is the cleaner path.
Italian Embassy DoV. The DoV counter rarely accepts the notarised affidavit alone for name mismatches; the Tehsildar one-and-same certificate is the standard. For other supporting purposes (gap year, parent consent), the affidavit is accepted with apostille.
German Standesamt and German universities. Notarised affidavit with marriage certificate accepted for most name-mismatch cases. Apostille on the affidavit; German translation by vereidigter Übersetzer in Germany.
UAE bank, UAE court, UAE business. Joint ownership, signatory designation, business-purpose affidavits. Notary, SDM, MEA apostille, UAE Embassy + UAE MOFA inside India, Arabic translation.
Saudi MOFA, Kuwait MOFA, Qatar MOFA, Bahrain MOFA, Oman MOFA. Address proof, identity declaration, family-relationship affidavits for visa applications. Notary, SDM, MEA apostille (Saudi/Oman Hague), embassy attestation for non-Hague (Kuwait/Qatar/Bahrain), Arabic translation.
UK Home Office for spouse visa, family visa, settlement. Various supporting affidavits; relationship affidavit, address affidavit, family-funding affidavit. Notary, SDM, MEA apostille. English text accepted directly.
Canadian provincial bodies (universities, employers, NACES providers). Name-mismatch affidavits for WES Canada, ACS-equivalent assessments, university admissions. Notary, SDM, MEA apostille.
Schengen consulates for residence applications. Address affidavits, gap year affidavits, relationship affidavits. Notary, SDM, MEA apostille, destination-language translation.
USCIS for I-130 spouse petitions, K-1 fiancée, family petitions. Relationship affidavits supporting the petition. Notary, SDM, MEA apostille (apostille not strictly required by USCIS, often added when documents go to OCI in parallel).
What we will not pretend about an affidavit
We do not draft affidavits as legal counsel. The affidavit content is a legal declaration; the drafting is best done by a lawyer who can advise on the destination authority\'s acceptance and on the specific claims being made. We can share template structures for common affidavit types that have worked at common destinations, but the lawyer\'s drafting is what gives the affidavit its substantive integrity.
We do not influence destination acceptance. Italian DoV rejecting affidavit-only one-and-same in favour of Tehsildar certificate is the DoV\'s call. CKGS rejecting affidavit-only OCI applications is CKGS\'s policy. Where we know the affidavit-only path is risky for a specific destination, we name it at intake.
We do not work with fabricated or false affidavits. The applicant swears to the truth of the affidavit before a Notary; perjury is the applicant\'s risk. Where the affidavit contradicts other documents on file, the destination authority identifies it.
When you actually need to send us the Original
Translation of an affidavit runs from a scan of the sworn stamp paper. The translator works from the image of the executed affidavit and delivers the translated version on email; wet-signed hard copy by courier where the destination authority asks. The Original stamp-paper affidavit stays with you for translation-only cases.
Apostille on the affidavit needs the Original because MEA stamps the actual stamp paper. For ACS Australia, US OCI, German Standesamt, Italian DoV, UAE bank; most of which want apostille on the affidavit; the Original travels through Notary, SDM, MEA in physical form. Translation runs from the scan in parallel.
French is the translation case with a different rule. Authorised French Embassy translators sometimes verify the document against the Original where the document is not digitally verifiable. For French-target translation, we confirm at intake whether the verification step applies to your specific document.
Affidavit custody, with confidentiality for sensitive declarations
You can\'t mess with people\'s Original documents. Affidavits sworn at our coordinated Notary are logged at intake with a Customer ID, a Document ID per affidavit, and a Project ID tying the affidavit to the destination case (ACS Australia, US OCI, German Standesamt). For multi-affidavit bundles (name-change affidavit plus joint-ownership affidavit for the same UAE banking case), the bundle shares a Project ID.
The printed checklist that travels with the affidavit is signed at every handoff: Notary, SDM, MEA submission, MEA collection, embassy desk if applicable, translator, courier outbound to the destination authority.
We do not use Porter, Wefast, Borzo or similar third-party parcel apps for affidavit movement. Inter-city and international legs use Blue Dart, DHL, FedEx, DTDC Premium, UPS.

You WhatsApp the destination authority and the supporting purpose (name mismatch, gap year, joint ownership, parental consent). We share template language for common affidavit types and recommend lawyer engagement where the affidavit content is non-standard.
The affidavit is sworn before a Notary; either at our coordinated Notary in Delhi or Noida, or at a Notary of your choosing if you are in another city. For cases where apostille is part of the work, the Original comes to our Noida office. The Customer ID, Document ID, Project ID go on the printed checklist at intake.
The sequence runs: English translation if regional language, Notary attestation, SDM countersign, MEA apostille, embassy step for non-Hague destinations, destination-language translation where required.
The completed package travels by tracked courier to the destination authority or to the destination address. Photo and video proof of every stamp on WhatsApp before international dispatch.
Frequently asked questions
My passport says "Priya Verma" and my degree says "Priya Sharma" because I changed my name at marriage. ACS Australia wants an affidavit. What does the affidavit say?
A one-and-same affidavit on ₹100 stamp paper. The affidavit declares: full legal name as on the current passport (Priya Verma), name as on the degree (Priya Sharma), the reason for the difference (marriage on [date] to [spouse name]), and the declaration that "Priya Sharma" and "Priya Verma" refer to one and the same person. The affidavit is sworn before a Notary, countersigned by an SDM, and MEA apostilled. The marriage certificate (apostilled) and the name-change gazette publication accompany the affidavit at submission. ACS reads the bundle.
My birth certificate has a spelling error; "Mohammad" instead of "Muhammad." OCI is being held. Will an affidavit fix this?
For OCI specifically, the affidavit-only fix is risky. CKGS has rejected OCI applications for single-letter spelling differences on birth and marriage certificates, even with supporting affidavits. The cleaner path is a corrected certificate from the issuing sub-registrar, then apostille on the corrected version. For OCI cases, do not gamble on the affidavit-only path. For other destinations (Italy DoV, German Standesamt, ACS Australia), an apostilled affidavit alongside the original certificate is sometimes accepted; Italy still tends to insist on a Tehsildar one-and-same certificate or a corrected birth certificate.
My child has a gap year between school finishing and starting university. The destination university wants a "gap year affidavit" from the parent. What does that say?
A gap year affidavit is sworn by the parent (or by the student if 18+). It declares the period of the gap, the reason (medical, family, exam preparation, work experience), and confirms that the student was not engaged in any other formal study during the gap. Universities in the US, UK, Australia, Canada, Germany sometimes ask for this when the academic timeline shows a gap. The affidavit is on ₹100 stamp paper, Notary, SDM, MEA apostille. English text is standard.
Italy DoV is asking for "Tehsildar one-and-same certificate," not just a notarised affidavit. What is the difference?
The Tehsildar one-and-same certificate is a different document from a notarised affidavit. The Tehsildar (a revenue officer at the sub-district level) issues the one-and-same certificate after verifying the applicant's identity, the name forms, and the reason for the variation. The certificate is issued on the Tehsildar's letterhead and is signed by the Tehsildar. A notarised affidavit, by contrast, is sworn by the applicant before a Notary; the Notary attests the swearing but does not verify the substantive claims. Italian Embassy DoV reads the Tehsildar certificate as the verified document; the affidavit alone is not accepted. Tehsildar issuance takes 2 to 4 weeks at the applicant's residence district.
My father has my UAE address and I have my Indian address. UAE bank wants a joint-ownership affidavit. Can I draft and notarise in India?
Joint ownership affidavits for father-son or other family co-ownership of property or financial assets are routinely drafted in India. The affidavit names the property or asset, the joint owners, the share each holds, and the declaration of joint ownership. Both joint owners sign before a Notary in India. SDM countersign, MEA apostille, UAE Embassy + UAE MOFA attestation, Arabic translation. UAE bank reads the apostilled affidavit alongside the asset documentation.
I have already published a name change in the Indian Gazette. Do I still need an affidavit alongside?
For most destinations, the gazette notification alone is not sufficient; the name change bundle is: notarised affidavit declaring both name forms refer to one person, gazette publication, supporting ID documents (Aadhaar, PAN, passport). Each element supports the others. For Italy, the affidavit needs to be apostilled. For Germany, the affidavit can be plain notarial. For US OCI, the gazette plus the affidavit plus the updated passport. The gazette alone is the central legal act; the affidavit and supporting docs are the verifiable bundle.
My affidavit is in Hindi from a Lucknow Notary. The German Standesamt wants German. Where does translation fit?
English translation by a certified translator of the Hindi affidavit, with translator's certification of accuracy, first. The original Hindi affidavit and the English translation are stapled together. Notary attests the translator's declaration. SDM countersign on the bundle. MEA apostille. German translation by vereidigter Übersetzer in Germany. The Standesamt reads the German version alongside the apostilled English-Hindi bundle.
How long does the affidavit apostille work take from your end?
For an affidavit sworn at our coordinated Notary in Delhi or Noida: 5 to 8 working days at our end for Notary, SDM, MEA apostille. Add 3 to 5 working days for embassy attestation if non-Hague. Add 5 to 10 working days for destination-language translation (Arabic for Gulf, German via vereidigter, Italian via empanelled). Add 3 to 7 working days for international courier. End-to-end Hague destinations: 10 to 18 working days. For Tehsildar one-and-same certificate cases (Italy), add 2 to 4 weeks for the Tehsildar issuance ahead of the work.
